Boating Safety in New York
Under Brianna's Law, all operators of motorized vessels in New York—regardless of age—must hold a boating safety certificate. Here's what you need to know to stay safe and stay legal on the water.
Who Needs a Boating Safety Certificate?
Starting January 1, 2025, a boating safety certificate is required of all operators of motorized vessels in New York, regardless of age (operators must be at least 14). This requirement is the result of the phased rollout of Brianna's Law.
Anyone operating a personal motorized watercraft (Jet Ski™, Wave Runner™, or similar) must also have a boating safety certificate and be at least 14 years of age or older.
Operators of non-motorized boats, such as kayaks and canoes, are not currently required to have a certificate, though they are encouraged to take a safe boating course as well.

Approved Online Boating Safety Courses
With an approved online course, learning is completed online and successful completion of unit exams is required to advance through the course. Fees paid to the online provider typically include the cost of your permanent certificate, which is issued by the provider.

The New York State Adventure License Program
Anyone who successfully completes the New York Safe Boating Course may opt to have their driver's license, non-driver ID, or learner's permit indicate completion of the course with an anchor icon. That means you can carry proof of your certificate wherever you go without needing to keep the paper card on hand.

You may rent and operate a motorboat from a livery without first obtaining a boating safety certificate. In that case, staff at the livery must provide basic instruction and safety information before you depart the dock.
Fines and Enforcement
While the New York State Department of Environmental Conservation (DEC) is the primary enforcement agency, other law enforcement entities such as the State Police and Park Police may also check for proof of certification.
- According to a press release from the Governor's Office, failure to comply could result in a fine of between $100 and $250 under Brianna's Law.
- Other sources indicate that a first violation may be punished by a fine of not less than $25 or not more than $100, by imprisonment for not more than seven days, or by both fine and imprisonment. Penalties typically increase for a second violation.
- No driver's license points: These boating violations are not added to your driving record and do not result in points being added to your driver's license.
